A Single bench of Karnataka High Court in the case “Divena Nayudu vs. The Government of India” has held the right to travel abroad is a fundamental right guaranteed under Article 21 of the Constitution and that the Regional Passport Officer ought not to have insisted for presence or consent of the father to process the passport application of a nine-year-old child. The Court further held that mere issuance of passport would not result in the curtailment of visitation rights granted to the father whereas the mother had exclusive custody of the child.
